From today, the Competition Authority invites public discussion of the draft review of its Regulations on Fees for Services Rendered. The object of the review is to allow simpler, faster and more economic access to documents by citizens and enterprises that have the right to such access.
It is six years since the approval of Regulation No. 47/2004 (Diário da República (Government Gazette), Series II, of 22 December 2004), which sets the fees for certificates or opinions and other acts representing a service provided to private bodies by the Competition Authority. It is felt that it is now necessary to review and update the system of fees approved by the above legislation.
In the draft Regulations now being submitted for public consultation, the Competition Authority foresees the possibility of making digital copies available for a reduced fee and considers the possibility of the forwarding of documents by mail (e-mail or the postal service). These represent innovations in relation to earlier practice.In this draft, the system of fees charged for certificates and authenticated copies will also be simplified: it will now have a single rate per page.
Other changes to the content of Regulation No. 47/2004 are necessary in the light of subsequent legislative options. As the lawmakers decided to eliminate the need to request and obtain opinions from the Competition Authority in order to be granted a tax benefit and be exempted from registration fees, the present Regulations will no longer set fees for such opinions.
This public consultation seeks to gather contributions to the content of the draft of the Regulations. All the documentation available for the purpose is provided with this press release.
