Fees

The prior notification of a concentration between undertakings is subject to the payment of fees under the terms established in Regulation nr.º 1/E/2003, 25 July 2003 - Regulation on the Fees Payable for the Appraisal of Concentrations between Undertakings.

Amounts of the Notification Fee:
  • Basic Fee (First Phase investigation): €7 500; €15 000; or €25 000, calculated in accordance to the previous financial year's combined turnover in Portugal for the companies involved in the concentration
  • Fee for in-depth investigation (Second-Phase Investigation): Additional Fee corresponding to 50% of the basic fee
  • Fee for Official Proceedings: equivalent to double the amount of the basic fee applicable
 
Form of payment of the Notification Fee – Bank Account of the Portuguese Competition Authority (PCA):
The payment of the fees applicable to concentrations between undertakings, under the terms established in article 56.º of Law nr.º 18/2003, 11 June (Competition Act) and in accordance with Regulation nr.º 1/E/2003, 25 July 2003, of the PCA, must be made by a bank deposit:

All expenses with bank transfers for the payment of the fees applicable to concentrations between undertakings are borne by the notifying undertaking (s).

  • Regulation nr.º 47/2004, 23 December 2004 – Establishes the Fees applicable to services supplied by the PCA.
